HIPAA Notice of Privacy Policies

This notice describes how your Protected Health Information (PHI) may be used and disclosed and how you can get access to this information. Please read and review carefully. The information that can be used and disclosed without the patient’s prior authorization. The information that can NOT be used and disclosed without the patient’s prior authorization Pharmacy on the Bosque, LLC is required by Federal and New Mexico state regulations to protect the privacy of your PHI. Pharmacy on the Bosque, LLC is required to comply the Federal Health Insurance Portability and Accountability Act (HIPAA).


Our Responsibilities

Pharmacy on the Bosque, LLC is required by law to:

  • Maintain the privacy and security of your protected health information (PHI)

  • Provide you with this notice of our legal duties and privacy practices

  • Notify you in the event of a breach that compromises your PHI

  • Follow the terms of this notice


Patient’s prior consent NOT required to use and disclose your health information in the following ways:

  1. To the individual: who is the subject of the information.

  2. Treatment: Pharmacy on the Bosque can use your health information to fill prescriptions and provide medication therapy, including compounded medications. We may share information with your healthcare providers to coordinate your care.

  3. Payment: Pharmacy on the Bosque may use and disclose your information to bill and collect payment from you, your insurance company, or a third party for services we provide.

  4. Healthcare Operations: we may use your information to manage our business activities, such as quality assessment, training, accreditation, and compliance activities.

  5. Other permitted uses and disclosures: Pharmacy on the Bosque may also use or disclose your information in the following circumstances:

  • Public Health and Safety: To prevent disease, report adverse events with

  • medications, report abuse or neglect, or to the FDA.

  • Legal Requirements: When required by law, such as in response to a subpoena or court order.

  • Law Enforcement and Government: To law enforcement officials or authorized

  • government agencies as required or permitted by law.

  • Health Oversight Activities: For audits, inspections, or investigations by

  • government health agencies.

  • Business Associates: We may disclose your information to vendors or contractors who perform services on our behalf (e.g., billing services), and we require them to protect your information.

 

Patient’s prior consent required to use and disclose your health information:
For purposes other than stated above, Pharmacy on the Bosque is required to ask for patient’s written consent/authorizations before using or disclosing any of their PHI. When Pharmacy on the Bosque requests an authorization, any of patients may decline to accept the request. If any patient gives us an authorization, the patient has the right to revoke the authorization.


Patient’s Rights

  1. The patient has the right to be treated with dignity and respect. 

  2. The patient has the right to competent counseling and is encouraged to obtain from pharmacists and other direct caregivers relevant, current, and understandable information concerning their medication therapy and treatment. 

  3. The patient is entitled to the opportunity to discuss and request information related to their specific drug therapy, the possible adverse side effects and drug interactions. 

  4. The patient has the right to make decisions about the plan of care prior to and during the course of treatment and to refuse a recommended treatment or plan of care. 

  5. The patient has the right to expect that all communication, discussion, and patient counseling will be conducted so as to protect each patient's privacy. 

  6. The patient has the right to have the pharmacist serve as one of the patient’s advocates for appropriate drug therapy and to make reasonable efforts to recommend alternative choices in collaboration with the patient’s physician. 

  7. The patient has the right to be informed in advance of charges of services and products upon request. 

  8. The patient has the right to be informed of Patient’s Responsibilities. 

  9. The patient has the right to file a complaint with the New Mexico State Board of Pharmacy.

  1. The patient is responsible to provide pharmacy personnel with requested information and identification in compliance with federal and local laws. 

  2. The patient assumes responsibility for appropriate handling and storage upon receipt of prescription. 

  3. Participate in your care plan by asking questions and clarifying instructions for appropriate use. 

  4. The patient will notify the pharmacy of any problems or dissatisfaction with the pharmacy-provided services. 


Effective health care requires collaboration between patients, pharmacist and other health care professionals. Pharmacists must ensure to respect the patient’s decision- making on treatment choices and other aspects of their care. Upon request, patients are responsible for providing comprehensive information about their medications as well as a history of their drug and food allergies. To participate effectively in decision- making, patients are encouraged to take responsibility for requesting information or clarification about the drugs they are taking
when they do not fully understand information and instructions.

Pharmacy on the Bosque will not retaliate against you for filling a complaint.


Changes to this notice.

We reserve the right to change the terms of this notice, and the changes will apply to all information we have about you. The new notice will be available upon request, in our pharmacy, and on our website.
